What kinds of discrimination are prohibited under the Act?

All protected persons1 have the right to non-discrimination in the private or public sector. Any denial, discontinuation or unfair treatment in the following amounts to discrimination:

  1. Employment or occupation,
  2. Healthcare services,
  3. Educational institutions and services,
  4. Access to goods, accommodation, services, facilities, and public spaces ( such as shops, restaurants, hotels, wells, burial grounds),
  5. Right of movement,
  6. Right to reside, purchase, rent, or occupy property,
  7. Standing for or holding public or private office,
  8. Government or private establishments providing care or custody, and
  9. Insurance (unless supported by actuarial studies).

A protected person includes people who are HIV-positive, people currently or previously living with an HIV-positive person, and those who have lost a partner or guardian to AIDS.
