Am I legally required to disclose my HIV status to my partner or anyone else?
No person with HIV is legally required to disclose their HIV status to anyone, unless a court specifically orders such disclosure in a case before it.
However, if an HIV-positive person is aware of how HIV is transmitted or has been counselled about it, the law expects them to take all reasonable precautions to prevent passing it on to others, including informing their partner of the HIV status before sexual contact. This duty does not apply to women where disclosure could lead to violence, abandonment, or serious harm to her or anyone close to her.
