Can someone disclose my HIV status without my permission?
Any person who has received information regarding an individual's HIV status in confidence, including a friend or co-worker, is not permitted to disclose that information without the individual's informed consent.
HIV-related information about a person with HIV can only be disclosed without their informed consent in the following situations:
- If a court orders it in the interest of justice,
- In a court case where it is necessary for filing a lawsuit or for legal proceedings,
- By healthcare providers to other healthcare providers for treatment, or the partner,
- In anonymised statistical studies, and
- To specific government officials for monitoring and supervising HIV/AIDS programmes.
