Grievance redressal through an Ombudsman

The Ombudsman can be approached if a person experiences HIV-related discrimination or if any provision of the Act relating to healthcare services is violated.

  • After hearing both sides, the Ombudsman must give a decision within 30 days (within 24 hours if it is a medical emergency), with written reasons. 
  • Failure to comply with an Ombudsman's order within the specified time attracts a fine of up to ₹10,000, with an additional fine of up to ₹5,000 for each day till the non-compliance continues.
  • If a person is dissatisfied with the decision of the Ombudsman, they can approach the civil court.
