Grievance redressal through a Complaints Officer
All healthcare workplaces (hospitals, clinics, laboratories, blood banks, etc.) with 20 or more people, and all workplaces (offices, factories, etc.) with 100 or more people where there is a significant risk of HIV exposure, are required to appoint a Complaints Officer (CO).
- A complaint can be filed with the CO in person, by post, telephone, or email within 3 months of becoming aware of the violation (this can be extended by another 3 months)
- The CO must acknowledge the complaint, decide within 7 working days (on the same day for healthcare emergencies), and inform the reasons for the CO’s decision within 10 days
- If the Act has been violated, the CO can direct the establishment to rectify the violation, counsel the violator, or recommend disciplinary action for repeated violations
- The Ombudsman or court can be approached if there is dissatisfaction with the decision.
