Can I seek abortion while a criminal case (rape, POCSO Act, etc.) related to my pregnancy is ongoing?

Where a criminal case is ongoing regarding rape, incest, or sexual intercourse on the false promise of marriage, abortion can be sought irrespective of whether:

  1. The criminal trial has started or concluded, or
  2. An interim order, final order or judgment of the criminal case has been passed by the court.

Where pregnancy is caused due to rape, survivors are given the option to undergo an abortion, which is to be provided as an emergency healthcare service at the time of the medical examination.
